Indemnity form 

The Indemnity form must be printed, filled out and handed in before the child’s first class.

FEES


  1. Fees are due in advance 7 days BEFORE the start of the new TERM.
    2. Registration fees are NOT included in the termly fee and must be paid in FULL at the beginning of each term and/or when the child joins Ballito Artistic gymnastics club.
    3. Fees outstanding for 3 months: children will not be allowed to participate in classes or competitions as it will be assumed that there has been a breach of contract by the parent. The parent/guardian will be legally obliged to pay all outstanding fees as well as the three months’ notice period.
    4. Students will not be allowed to attend class if fees are outstanding.
    5. Parents/guardians must undertake to pay tuition fees within 7 days of the start of the new term.
    6. The FULL fee is payable even if the student does not attend.
    7. To cancel from the programme, three month's PAID notice is required.
  • The management reserves the right to refuse an application.
  • Parents and guardians agree to be bound by the rules, regulations, policies and procedures of the gymnastics club as determined and enunciated by the directors.
  • Three month’s written notice must be given when withdrawing a child from the club. This notice should be given on or before the first day of the child’s final term at the club, failing which the full amount for the following terms fees shall become due and payable. No exceptions will be allowed.
  • Parents/guardians must undertake to pay tuition fees within 7 days of the start of the new term.
  • All parents must undertake to pay all annual fees as stated in fee structure.
  • The management is entitled to instruct their attorneys to attend to the collection of outstanding accounts, and both parents (whether natural, adoptive or foster) shall be held jointly and severally liable for the payment of all costs so incurred, on the scale between attorney and own client, including collection fees.
  • The management may in their sole discretion make changes and adjustments to fees and other charges and shall give one month’s written notice thereof.
  • Parents must obtain a clearance letter when moving from one club to another in order to avoid disqualification of the child in competitions.
  • Parents agree that in the event of an emergency arising in terms of which the child will require urgent medical attention, the child may be taken to the nearest hospital, clinic or doctor at the discretion of the management or authorized member of staff. The parents undertake to accept full responsibility for any medical costs incurred in the event of such an emergency.
  • I have read, understand and will abide by the rules of the club.

WAIVER OF LIABILITY AND ASSUMPTION OF RISK.


The equipment remains the property of Ballito Artistic Gymnastics and in the event of any damage being caused to the equipment through fault of the user; the participant is liable to pay for the repair/replacement. All participants/guardians must understand that gymnastics of any nature can be a dangerous activity. Whilst we make all attempts to safeguard our customers from such dangers, accidents & injuries can happen. In agreeing to take part in this activity & signing this disclaimer, you are acknowledging these dangers and agree to take part at your own risk.

I knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for my and or acting on behalf of a participants participation; and I willingly agree to let my child comply with the stated instructions and policies and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will bring such to the attention of the nearest coach immediately.

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify and hold Ballito Artistic Gymnastics, the Recreation Centre, Gymnastics South Africa, and their officers, officials, agents and/or employees, other sport participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event or activity (“Releases”) harmless with respect to any and all injury, disability, death, or loss or damage to person or property, caused by negligence or misrepresentation, to the fullest extent permitted by law.

I understand, agree and acknowledge that some activities may be of a hazardous nature and/or include physical and/or strenuous activity. Understanding this, I state that I have no medical condition or impairment that might inhibit my safe and active participation in the above listed activity. In addition, I understand that Ballito Artistic does not provide medical insurance coverage for activity for participants and that such participants must provide any applicable medical insurance individually. In the case of injury or medical emergency and in the event participant, or their parent or guardian, cannot respond at the time of the emergency, Ballito Artistic Gymnastics has permission to seek, administer, or have administered whatever first aid or emergency medical care deemed necessary for participant’s welfare, and it is understood that participant, and not Ballito Artistic Gymnastics, shall be responsible for any and all charges for such health care services regardless of whether participant’s medical insurance would cover such charges.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. MY SIGNATURE OF CONSENT OCCURS IN THE FORM OF CLICKING "AGREE TO TERMS AND CONDITIONS"

COVID-19 INDEMNITY

Ballito Artistic Gymnastics Club, Gymnastics South Africa, their Discipline Management Committee, staff and volunteers will act in a responsible and ethical manner at all times to serve the best health interests of teams and individuals, regarding compliance with respect to health and safety matters relevant to Covid19 and variants. This includes assessments of prevailing and present conditions and circumstances and local South African health regulations as stipulated by South Africa’s Ministries of Health and Immigration.

By entering Ballito Artistic Gymnastics Club, Gymnastics SA or its affiliated members events, all participants agree to comply to all Covid19 regulations and protocols as stipulated by Gymnastics SA. At all times the Covid19 requirements and compliance as stipulated by Gymnastics SA (under advisement of approved authorities) supersedes any team members, individuals or family’s personal views and beliefs regarding the prevailing Covid19 situation at the time.

SAFE- GUARDING COMPLIANCE

By registering with Ballito Artistic Gymnastics Club and Gymnastics SA and by entering their and their affiliated members events I agree to abide by all of Gymnastics SA Safeguarding regulations, including, but not limited to ensuring my family, friends or supporters are also aware of these rules. This includes parents only recording images or recordings of their own child’s participation and results. Any form of harassment or abuse will not be tolerated, this includes verbal, emotional and physical.

SAFETY

We are safety conscious! Please help us by abiding by these rules:-

Do not work/play on apparatus without supervision of a coach

Do not play in/ on equipment, or around the gym, 

Non-participants may not under any circumstances interfere with classes, play in the gym or on any of the apparatus.

Spectators are welcome to watch from our seating areas or play in our demarcated play area.

All staff members are fully compliant with Gymnastics SA Safeguarding policy and are in possession of a valid coaches licence and 1st aid certificate.

DRESS CODE

-Bare feet

-Long hair to be tied back & out of face

-Leotard / Swimming Costume or T- Shirt & Shorts.

-No jewellery (Stud earrings only)

-Nothing loose in your mouth

POPI ACT COMPLIANCE

In terms of the Compliance to the Protection of Personal Information Act (PoPIA), also known as the POPI Act, Ballito Artistic Gymnastics Club and Gymnastics South Africa only collect data that we require for training and events as well as for statistical reporting purposes. We apply reasonable security measures to protect all your data. By registering with Ballito Artistic Gymnastics Club and Gymnastics SA or its affiliated members events, the gymnasts/participants and their parents/guardians (where applicable), hereby give all necessary consents and approvals for Ballito Artistic Gymnastics Club and Gymnastics South Africa, and all their agents/officials or similar, to divulge, use or disclose supplied information, documents or similar and acknowledge that the spirit and purpose of events cannot be pursued or fulfilled without disclosing, using or divulging the afore-mentioned information, documents or similar.
